Terms of Service

1. Who we are

1Chat is a product of CapeAI (Pty) Ltd(“CapeAI”, “we”, “us”), a South African company operating from the Western Cape. These Terms of Service (“Terms”) govern your access to and use of the 1Chat website, chat application, image generation service and any related services (collectively, the “Service”).

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

1Chat provides a unified interface to multiple third-party artificial intelligence models (including models from OpenAI, Anthropic, Google, xAI, DeepSeek, Moonshot, Groq, Alibaba and others) for text chat and image generation. Models and providers may change at any time.

3. Eligibility

You must be at least 18 years old to create an account. Users aged 13 to 17 may use the Service only with the verifiable consent of a parent or legal guardian who accepts these Terms on their behalf. The Service is primarily intended for users in South Africa; by using it from elsewhere you are responsible for compliance with local law.

4. Accounts

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us immediately at our contact form if you suspect unauthorised access.

5. Acceptable use

You agree not to use the Service to:

  • violate any law or the rights of others;
  • generate, distribute or store unlawful, defamatory, harassing or sexually explicit material involving minors;
  • produce content that infringes intellectual property or privacy rights;
  • attempt to reverse engineer, resell, scrape or abuse the Service or underlying models;
  • inject prompts designed to extract system instructions, circumvent safety filters or cause the Service to misbehave;
  • build a competing product using the Service’s outputs.

We may suspend or terminate accounts that breach these rules.

6. Credits

Paid features are metered in credits. Credits are allocated monthly based on your subscription tier and can also be purchased as top-ups.

  • Credits are non-refundable once consumed.
  • Unused monthly-allocation credits roll over for a maximum of 30 days; anything older is forfeited.
  • Top-up credits roll over for 12 months from purchase.
  • All credits expire immediately when your subscription is cancelled or your account is closed, whether by you or by us for breach.
  • Credit prices per message or image vary by model; estimates are shown in-app and are not guarantees.

7. Subscriptions and billing

Paid tiers are available as monthly subscriptions priced in South African Rand and inclusive of VAT. The Free tier lets you try 1Chat with rate-limited access to free models — no card required. Paid subscriptions are billed at signup and provide access for 30 days. You may cancel at any time; access continues until the end of the current paid period.

We may change prices with at least 14 days’ notice, effective at your next renewal. Continued use after the change constitutes acceptance.

8. Cancellation

You may cancel at any time from your account settings or by emailing our contact form. Cancellation takes effect at the end of the current billing period; you retain access until then and any unused credits expire at that point. See our Refund Policy for the limited circumstances in which refunds are available.

9. Intellectual property

CapeAI owns the Service, including its software, branding and content, other than user-submitted prompts and user-generated outputs. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal or internal business purposes.

10. AI-generated content

Subject to these Terms, you own the outputs you generate through the Service (“Outputs”). However:

  • Outputs may be similar or identical to outputs generated for other users; we make no guarantee of uniqueness.
  • Outputs may be inaccurate, biased or offensive; we make no guarantee of accuracy, fitness for purpose or originality.
  • You are responsible for reviewing, verifying and using Outputs lawfully, and for disclosing AI involvement where required.
  • Some third-party model providers retain rights over their weights and impose their own usage restrictions; by using those models you agree to the applicable provider policies.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure or free of harmful components, nor that any Output is accurate, complete or reliable. The Service is not a substitute for professional medical, legal, financial or other advice.

12. Limitation of liability

To the maximum extent permitted by law, CapeAI’s aggregate liability to you for any claim arising out of or relating to the Service is limited to the amounts you paid us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or reputational harm.

13. Indemnity

You agree to indemnify and hold CapeAI, its directors, employees and agents harmless from any claim, loss or expense (including reasonable legal fees) arising from your use of the Service, your Outputs, or your breach of these Terms or any law.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute will first be addressed through good-faith negotiation. If unresolved, the parties will attempt conciliation or mediation through a recognised South African alternative dispute resolution body before escalating to the courts of the Western Cape Division, Cape Town, which have exclusive jurisdiction.

Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
